Modification, Suspension, or Revocation of Permits By the Division (continued) <br />(b) At the request of the permittee, the Division may modify or lertninate this permit if the following conditions are met: <br />(i) In the case of ternmination, the pennittee notifies [he Division of its intent to terminate the permit 90 days prior to the <br />desired date of termination and the permittee has ceased any and all discharges to state waters and demonstrates <br />to the Division there is no probability of further uncontrolled discharge(s) which may affect waters of the State. <br />(ii) The Environmental Protection Agency has been notified of the proposed modification or termination and does not <br />object in writing within thirty (30) days of receipt of notification; <br />(iii) The Division f Inds that the pemmittee has shown reasonable grounds consistent with the Federal and State statutes <br />and regulations for such nmodification, amendment or termination; <br />(iv) Fee requirements of Section 6.16.0 of State Discharge Permit System Regulations have been met; and <br />(v) Requirements of public notice have been met. <br />6. Oil and Hazardous Substance Liability <br />Nothing in this permit shall be construed to preclude the institution of any legal action or relieve [he permittee from any <br />responsibilities, liabilities, or penalties to which the permittee is or may be subject to under Section 31 I (Oil and Hazardous <br />Substance Liability) of the Clean Water Acl. <br />7. State Laws <br />Nothing in this permit shall be constmed to preclude the institution of any legal action or relieve the pernmittee from any <br />responsibilities, liabilities, or penalties established pursuant to any applicable State law or regulation under authority granted <br />by Section 510 of the Clean Water Act. <br />8. Permit Violations <br />Failure to comply with any terms and/or conditions of this permit shall be a violation of this pemmit. The discharge of any <br />pollutant identified in this permit more frequently than or at a level in excess of that authorized shall constitute a violation of <br />the permit. <br />9. Property Rieh[s <br />The issuance of this permit does not convey any property or water rights in either real or F~ersonal property, or stream flows, <br />or any exclusive privileges, nor does it authorize any injury to private property or any inv;rsion of personal rights, nor any <br />infringement of Federal, State or local laws or regulations. <br />10. Severabilitv <br />The provisions of this permit are severable. If any provisions of [his permit, or the application of any provision of this permit <br />to any circunmstance, is held invalid, the application of such provision to other circumstances and the application of the <br />remainder of this permit shall not be affected. <br />vq-n~.7 •~~,,,, <br />
