Uept. of Natural Ftesources <br />AMAX realizes the complicating circumstances presently acting to delay <br />the processing of mining/reclamation applications at the State Mined Land <br />Reclamation Division. Nevertheless, AMAX must protect its legal rights. <br />The Henderson application was delivered to the staff (and accepted) on <br />September 29, 1977, A phone call to you on October 11, 1977, revealed that <br />the application had not yet been evaluated for completeness by that time <br />and under these circumstances, according to Section 1.1(10) of the Rules and <br />Regulations, "the application shall be treated as 'filed,' 'submitted' or <br />'received' as of the date of the receipt of the application in the Division's <br />office," i. e. September 29, 1977. <br />In view of these facts, AMAX began publication as required on October 13, <br />1977. Publication on this date was necessary because both local newspapers <br />in the respective counties are weeklies, hitting the streets on Thursdays. A <br />copy of the notice is enclosed. <br />In view of the statutory requirement of publishing within 10 days of <br />filing and the latest emergency revision to Section 1.1(10) of the Rules and <br />Regulations by the Board on September 29, 1977, AMAX hereby requests that the <br />Henderson mining/reclamation filing date be moved from September 29, 1977, to <br />October 3, 1977. I would appreciate a written response to this request. <br />
