ISSUES <br />Presentations to the Boazd shall be limited to the following issues. The parties shall limit <br />presentations to the question of whether the pending application should be approved or denied, <br />based on the issues stated below. <br />1. Has the Applicant provided an effective plan for stabil'.ization and protection of the <br />stockpiled material from wind erosion? (34-32.5-116(4)(j)) <br />2. Has the Applicant provided an adequate timetable and map to establish the relationship <br />between mining and reclamation? (Rules 6.4.4(1)(e), 6.4.5(2)(e) and 6.4.6) <br />3. Was the Applicant in violation at the time of application for the 27 acres to be transferred <br />from Permit No. M-1991-140? (34-32.5-120) <br />4. Has the Applicant proposed measures to minimize impacts to the hydrologic balance of <br />the Brattner and Brighton ditches? (Rule 3.1.6(1) and (3)) <br />5. Has the Applicant proposed measures to minimize impacts to the hydrologic balance of <br />Marilyn Kent's water well? (Rule 3.1.6(1)) <br />6. Has the Applicant adequately addressed the requirements for inert fill generated oustide <br />the approved permit azea? (Rule 3.1.5(9)) <br />1V. WITNESSES AND EXHIBITS <br />Pursuant to Construction Materials Rule 2.6(2), all parties must exchange witness and exhibits <br />information as set forth below no later than 5:00 p.m. fifteen working days prior to the formal <br />Mined Land Reclamation Boazd heazing. <br />Parties must make a list identifying all witnesses that each ma;y call to testify during the hearing. <br />Identify each witness by name, address, phone number, azea o:f expertise (if any) and subject(s) of <br />
