The Society strongly urges the Board of <br />Mined Land Reclamation not to grant declaratory relief in this case. <br />The Colorado Archaeological Society believes that granting such declaratory <br />relief will set an unacceptable precedent that goes against both the letter <br />and spirit of the Act. We believe that the Act clearly gives authority to <br />the Board of Mined Land Reclamation to require an evaluation of the <br />potential for adverse affiects to cultural resources as a part of its permit <br />process. We believe that the intent of this Act was to give the State the <br />authority to be a steward of cultural resources to preserve them for the <br />education and enjoyment of the present and future citizens of the State. <br />Cultural resources are a non-renewable resource and are under siege by <br />private development and willful destruction from those who hope to profit <br />from their actions. This ongoing destruction has been escalating and is a <br />major concern of the Society.
