County Attorney r"~ ,.~ <br />Wilma .Thatcher l.._Deputy___......., Clerk of the Board (~u"' <br />when the tollowing prooeadinga, among others were had end dom, to•wit: <br />- CASE <br />WHEREAS, on the 30th day of December, 1985, the Board of County <br />Commissioners, held a public hearing on the application of <br />Colorado Sand and Gravel Company, Case #120-85-C, requesting <br />amendment to Conditional Use for gravel mining (Case Nos. <br />101-81-ZCP and 52-80-ZCP), on the following described property: <br />Sandy Acres Subdivision - 42.75 acres: Apart of the SE}, <br />Section 26, and a part of the NE} of the N}, Section 35, <br />T1S, R67W, 6th P.M „ Adams County Colorado. <br />Pinewood Estates Subdivision, except the west 240' of lots 1 <br />and 2, 33.00 acres. Apart of the NE} of the SE}, Section <br />26, and a part of the NW} of the SW}, Section 25, T1S, R67W, <br />6th P.M., Adams County, Colorado. <br />-• APPROXIMATE LOCATION: 132nd Avenue and Nome Street. <br />NOW, THEREFORE, BE IT RESOLVED, by the Board of County <br />Commissioners, County of Adams, State of Colorado, that the <br />application of Colorado Sand and Gravel Company,'Case #120-85-C, <br />requesting amendment to Conditional Use for gravel mining on the <br />above described property, is hereby approved, subject to the <br />following: <br />CONDITIONS PRECEDENT: (To be met prior to March 30, 1986) <br />1, a. Slopes should be in conformance with the requirements of <br />the Adams County Zoning Regulations and SH:IV slopes for <br />the sandbar swimming area to a depth of 5 feet below the <br />water surface elevation and 2H:IV thereafter. <br />b. Deletion of reference to "backfill permitting" on require- <br />ment to provide irregular short line. <br />c. Provision for a screen of trees adjacent to U.S. 85 at a <br />density of one tree per 500 square feet within a ten foot <br />strip the length of the property. <br />d. Substitution of Luna Pubescent Wheatgrass for Russial <br />Wildrye in seed mixture, <br />2. Submittal of a revised mining plan showing: <br />a. The haul route to be to Nome Street, then south to U.S. <br />85, <br />b. No mining of a 10.5 acre parcel at the northeast corner of <br />the site, for a period of one year after approval of this <br />application, to preserve right-of-way for purchase by the <br />E-470 Authority. <br />3. Applicant must obtain all necessary state permits, including <br />any required by the Air Quality Control Commission, <br />11.1111 10..
