This mining plan approval document is issued by the United States
of America to:
Somerset Mining Company
P.O. Box 535
Somerset, Colorado 81434
for the Somerset Mine mining plan for Federal lease COC-53510
subject to the following conditions. Somerset Mining Company is
hereinafter referred to as the operator.
1. Statutes and Regulations.--This mining plan approval is
issued pursuant to Federal lease COC-53510; the Mineral
Leasing Act of 1920, as amended (30 U.S.C. 181 et seg.); and
in the case of acquired lands, the Mineral Leasing Act for
Acquired Lands of 1947, as amended (30 U.S.C. 351 et sea.).
This mining plan approval is subject to all applicable
regulations of the Secretary of the Interior which are now
or hereafter in force; and all such regulations are made a
part hereof. The operator shall comply with the provisions
• of the Water Pollution Control Act (33 U.S.C. 1151 et seg.),
the Clean Air Act (42 U.S.C. 7401 et se .), and other
applicable Federal laws.
2. This document approves the Somerset Mine mining plan for
Federal lease COC-53510, and authorizes coal development or
mining operations on the Federal lease within the area of
mining plan approval. This authorization is not valid
beyond
T. 13 S.. R. 90 W., 6th Principal Meridian
Sec. 1: Lots 14 to 19, inclusive
Sec. 2: Lots 13 to 20, inclusive
Sec. 3: Lots 13, 14, 17, and 18
Sec. 10: Lots 1 and 2, and NE1/4SE1/4
Sec. 11: Lots 1 to 8, inclusive
Sec. 12: Lots 2 to 4, inclusive, SW1/4NW1/4, and those
parts of SW1/4NE1/4 and SE1/4NW1/4 lying north of
the North Fork of the Gunnison River
as shown on the map appended hereto as Attachment A.
3. The operator shall conduct coal development and mining
operations only as described in the complete permit
• application package, and approved by the Colorado Division
of Minerals and Geology, except as otherwise directed in the
conditions of this mining plan approval.
