That position was based upon a^ understanding that the issue ass the
silver detection limit, currently 0.0002 mg/1, and not the confidence interval.
Confidence intervals exist for all parameters, not dust silver. For this
reason, ae are unable to grant relief from potential enforcement action on
Chia basis. CYCC could certainly submit this argument as an affirmative
defense in an enforcement action. It should be noted that Sn an enforcement
action, ae take the magnitude of an exceedance into account when citing
violations.
We apologize for any confusion this has caused.
Sincerely,
~f~~~~~
Robert Shukle
Industrial Unit Chief
Permits and Enforcement Sectio^
43ater Quality Control Division
RJSlJCKldec
ac: Dun Mgtheas, Colorado Mined Lnnd Reclacation Division
Local N¢alth Department
Jim Chubrilo, D.E., Field Services Section, WQCD
o~~~o
~~ ~ . ~~
~~ : ` ° ~o
DC~G°~QQ4G~n]~G~14
d8y6 ~
Q
o-- o-oa~oo~ooooo ono
OCR G;1C CaL~~~;l
Thomas M.
