Cottony <br /> Division Director <br /> NaNral Resource Trustee <br />RE: SW Meadow, LLC, File No. M-2003-016 <br />Heir Sand and Gravel 112c Permit Application- Fourth Adequacy Review <br />Deaz Mr. Gesso, <br />Listed below aze the fourth adequacy review comments for the Heit Sand and Gravel 112(c) Permit Application, File No. M- <br />2003-016. The Division of Minerals and Geology ("Division") is required to make a recommendation no later than August 8, <br />2003, therefore, your response to the following adequacy review concerns should be submitted to the Division as soon as <br />possible. <br />Per an eazlier conversation this date, please accept the previous requirements presented by the DMG that specifications for <br />the proposed French drain will be submitted to the DMG as a Technical Revision to the permit; further reporting on <br />groundwater and potential impacts will be submitted to the DMG in the form of a Technical Revision of Amendment to the <br />permit; and changes to the mitigation plan may require submittal to the DMG in the form of a Technical Revision of <br />Amendment to the permit. <br />Rule 6.4.5 Exhibit E- Reclamation Plan <br />1. The submitted reclamation plan indicates, "Mowing in phase 1 will be performed for at least 2 years following seeding to <br />help establish regenerating stands of grasses and to control weed infestation." Please indicate what measures will be <br />incorporated prior to seeding to control weed infestation at the site. <br />Rule 6.4.7 Exhibit G -Water Information <br />2. The third adequacy review requested that at least one upgradient location be included in the monitoring plan. The third <br />adequacy response states that the "groundwater flows in a generally northwesterly direction in the vicinity of the Heit <br />property. As such, we feel that New Piezometer #1, as located on Figure 3 of the second WWE report will reflect any <br />mounding that may occur on the upgradient side of the slurry wall." The first WWE report indicates that the alluvial <br />groundwater flow is to the north/northeast in the study area. Based upon this information coupled with the map included <br />in the fast WWE report (enclosed) depicting the predicted groundwater impacts resulting from the presence of the slurry <br />wall, the Division does not agree that the New Piezometer #1 will supply measurement which reflects the mounding <br />affect imposed by the slurry wall. Please submit a proposed monitoring location that will reflect the mounding effect, if <br />there is one, imposed by the slurry wall. <br />3. The third adequacy review letter indicated that the second WWE report indicates that groundwater level monitoring will <br />occur montlily for a minimum of one yeaz prior to mining to enable detemtination of baseline conditions, and requested <br />that the Applicant indicate the frequency of water level measurement following the first yeaz of activity at the site. The <br />third adequacy review response stated, "We propose that water levels will be read on atwice-monthly occurrence during <br />the fast yeaz of operations at the site."
