The conditions to the approval are noted below: <br />Stipulation No. 1 <br />The operator will comply with the UDFCD requirements pertaining to the <br />South Platte River setback criteria and associated floodplain management <br />procedures. The operator will also comply with any requirements pertaining <br />to the relocation of and accomodation of flow from Third Creek. <br />vStipulation No. 2 <br />The permit will not issue until the Division receives an agreement between <br />the operator and the McCann Ditch association. <br />Stipulation Na. 3 <br />Application approval is contingent upon local government approval. <br />The amount of financial warranty set by the Board for this operation is <br />5125,250.00. You must submit a financial warranty in this amount and a <br />performance warranty in order for us to issue a permit. In the event you have <br />requested a financial warranty form, we have enclosed it in this letter. If <br />you have not, please select a type of financial warranty from Rule 7.4. Then <br />contact us so that we can provide you with the appropriate warranty form.
