Submissions to the Division: The following are specific compliance <br />items which require permittee action. Please check the referenced <br />parts of the permit for details on what is required. <br />Office Permit <br />Code Event Citation Due Date <br />90508 Materials Containment Plan Part I.E 90 days after <br /> Update effective date <br />00201 Submit Low Flow Instream Part I.B 180 days after <br /> Study Plan effective date <br />2. Thirty Day Average: The permittee should note that the definition <br />for a thirty day average has changed. See page 2 of the permit. <br />Anne Ihlenfeldt <br />November 5, 1991 <br />E. Changes to the Permit and Rationale following Public Notice: <br />A comment letter dated January 21, 1992 from the permittee was received <br />during the public notice period. A comment letter dated January 16, 1992 <br />from EPA was also received during public notice. <br />1. Comments from Cripple Creek and Victor Gold Mining Company: <br />(a) Discharge Flow: The permittee objected to the automatic flow <br />increase and resulting change to effluent limitations in the event of <br />exploration or other mining activity in the Carlton Tunnel. The <br />permittee disagreed that underground mining activity would necessarily <br />impact flows from the Carlton Tunnel. The Division believes that <br />mining activity in the Carlton Tunnel or underground mining below the <br />Carlton Tunnel will require active pumping to drain the areas being <br />mined and will impact flows from the Tunnel. For any underground <br />mining fitting these criteria, the conditions in the permit will <br />apply. For any other mining activity proposed by Pike's Peak, the <br />Division will require Pike's Peak to subnit information as necessary <br />to determine possible water quality impacts and any changes in <br />monitorigg and/or limits that may be necessary in the permit. <br />
