To the best of my knowledge no board member of the Ouray
Ditch Company was aware, gave permission or realized the operator
of United Companies was going on private land outside their
permit area and replace our headgate and eliminate our release
of adjudicated water, esse~ftially taking all control of the
correct amounts and delivery of our existing water rights.
They performed this operation because ~f crossing land you were
going to give them an extention of their previous permit.
They have not followed the procedures outlined in the
original or AM-O1 application; as there is no siphon system in
place. We are at the mercy of United Companies to give us
water when and if and in the amounts they wish.
The fallacy in Your application, is there is nothi~ag to
protect the basic rights of adjoining property owners. Nothing to
stop big business fbnm making money at the expense of others.
The operator has rights, you as a govt. agency can fine them
and we the victims have-no guarantee of anything.
Enclosed is a letter dated 7/6/99 ::
• •
Discussing Water Rights, A Western Pastime
