r <br /> <br />2. Mining on the CAMAS property is limited to a period of no more than two (2) <br />continuous years. <br />3. Mining activities on the eastem boundary of the CAMAS property will be set back a <br />minimum of either 50 feet from the centerline of the Fulton Ditch or 25 feet from the western <br />boundary of the ditch right of way whichever is greater. <br />4. CAMAS has agreed to reclaim the property through the creation of lakes and/or <br />wetlands, and agreed to provide topsoil, and purchase and have planted cottonwoods with an <br />evergreen understory at 8 to ] 0 foot spacing along the eastem boundary of the CAMAS property. <br />5. We retained private access rights across the CAMAS property for recreational <br />purposes and for access to [he South Platte River. <br />6. CAMAS shall not permit the property to be used for public access, public recreation or <br />public use, except for a bike trail within 100 feet of the South Platte River. <br />7. CAMAS shall not cause the drawdown of the reservoir located on our property in a <br />manner which causes injury to our water rights, fish or spawning azeas in the reservoir. <br />Notwithstanding the cleaz understanding of the parties at the time we conveyed this land <br />to CAMAS, there is no mention of any of these covenants or conditions in the materials <br />submitted by CAMAS for this application. We aze concerned about these omissions, especially <br />the impact that the mining activity will have on our reservoir and the fish loss associated with a <br />drawdown of our water levels. <br />The information which we have reviewed in connection with the application contains <br />several statements that we feel are inaccurate or misleading and do not disclose the existence of <br />the covenants and agreements listed above. For example, CAMAS states that the only present <br />uses on the property are "range land for cattle ... and mobile home storage." In addition to our <br />clear recreational activity, we have an easement across [heir property for recreational purposes <br />and for ingress and egress. The documents also mention that a trail corridor and other <br />undisturbed property along both sides of the South Platte River may be conveyed to Adams <br />County. Again, such a conveyance would be limited by the terms of their deed. Appazently, <br />CAMAS anticipates mining in phases during a ] 0 year period. This clearly ignores the two year <br />limitation created in their deed. Finally, we again express our concern over the impact such <br />mining plans will have on our reservoir. We have spent a considerable amount of time and <br />money in making our reservoir an attractive recreational lake with an abundance of small mouth <br />bass, [rout and other species. We are concerned that CAMAS has neglected to make the State <br />aware of the activities occurring immediately adjacent to their proposed mining activity and of <br />their obligations to us. The courtesy of a phone call in advance of CAMAS' submittal could <br />have obviated the need for this letter altogether. <br />We aze more than willing to work with CAMAS in the development of their mining plan, <br />however, we intend to hold them accountable for each and every covenant contained in the <br />
