rartl
Page No. 4
Permit No.: CO-0043643
However, verbal notification shall be given to the Division within 24 hours of the occurrence of an}' discharge from
the Valley Leach Facility that may qualify for the exemption. Then, a report must be submitted within 5 days of [he
said discharge, documenting that the facility was maintained to contain the previously specified volumes. The
permittee must also submit documentation of the storm event, including the precipitation gauge station (or the
permittee's own gauge), the volume of runoff produced and the steps taken [o maintain treatment and minimize the
amount of overflow.
All da[a/documenta[ion required by [his section which can not be reported on applicable discharge monitoring report
forms (Dlvtlts) shall be reported in a letter as an attachment to the DMR. Submittal of documentation of
con[atnment, maintenance and precipitation records above does not exempt the permittee from any other notification
requirements of this permit.
d. Storm Exemption From BPJ. Federal Etlluent Limitations and Water Ouali[V Standard Based Limits - Discharee
Points 002A 003A, and 004A
[f, as a result of precipitation or sno+vmelt, discharges from any of the above points violate limitations based upon
best professional judgement, federal ELG's or water quality standard based limits, the discharge may qualify for
an exemption from such limitations if the following condiltons are met:
The facility is designed, constructed and maintained to contain the maximum volume of wastewater which
would be generated by the facility during a 24-hour period without an increase in volume from precipitation
and the maximtun volume of wastewater resulting from a 10-year, 24-hour precipitation even[ or treat the
maximum flow associated with these volumes. In computing the maximum volume of wastewater which
would result from a 10-year, 24-how precipitation event, the facility must include the volume which +vould
result from all areas contributing runoff to the individual treatment faciltty, t.e., all runoff that is not diverted
from the active mining area and runoff which is not diverted from the mill area. For the purposes of this
permit, the 10-)'ear 24-hour rainfall depth has been determined to be 2.4 inches.
ii) The permittee takes al] reasonable steps to maintain treatment of the wastewater and minimize the amount of
overflow.
iii) All notification requirements of the permit are complied with, including those listed below.
If the permittee intends to use the 10-year, 24-hour storm exemption, a report must be submitted within 90 days after
the effective date of this pemut, documenting that the facility is designed, constructed and will be maintained to
contain the water voltunes described above.
Also, verbal notification shall be given to the Division within 24 hours of the occurrence of any discharge that may
qualify for the exemption. Then, a report must be submitted within 5 days of the said discharge, doctunenting that
the facility was maintained to contain the previously specified volumes. The permiltee must also submit
documentation of the storm event, including the precipitation gauge station (or the permittee's own gauge), the
volume of runoff produced and [he steps taken [o maintain Vestment and minimize the amount of overflow.
All data/documentation required by this section which can no[ be reported on applicable discharge monitoring report
fotms (Dlvff2s) shall be reported in a letter as an attachment to the DME2. Submittal of documentation of
containment, maintenance and precipitation records above does not exempt the permittee from any other notification
requirements of this permit.
