2.05.4 page 2 <br />MR29, TR09 August 2005 <br />SURFACE FACILITIES REMAINING <br />All useable buildings which lie on Lawrence Huntington's property, including the shop and upper <br />pump house, along with the access road will be left intact at the request of Mr. Huntington. Mr. Huntington <br />has made such a request by letter to the Colorado M.L.R.D. and National King Coal, LLC (See Appendix <br />9(1)). The steep cut slope area behind the shop building will remain as is to allow continued use of the shop <br />by the surface landowner. This highwall was constructed during the summer of 1976. Don May, P.E., has <br />certified the stability of this azea (See Appendix 7). <br />The remainder of the surface buildings including the sales office, substation, old scale and storage <br />building adjacent to Burnwell #2 Tipple, etc., will be left intact and will be used to accommodate the stated <br />post mining land use. <br />Salvageable items (conveyors, motors, mining supplies and equipment) will be sold and removed <br />from the property or scrapped and be placed at the foot of the highwalls to be buried. Any non-woody, non- <br />toxicmaterial not sold and removed will be pushed against the highwalls and covered by at least 4 feet of <br />fill and plant growth medium as detailed elsewhere in this section. Woody material will be moved to the <br />burn pit near the lower pump house and burned. <br />The access road to the site will not be reclaimed but retained by the owners of the site for <br />transporting livestock to and from the area. The surface land owner has so requested by letter noted above. <br />Upon conclusion of mining, the water wells will be transfened to the landowners. The water well <br />shown on Map C-4, located in the meadow of Hay Gulch off the permit azea is the property of Mr. Wiltze <br />who leases its use to National King Coal. National King Coal, LLC has water rights at this well until <br />September 1, 2005, with renewal options there-afrer (See Appendix 2(7)). <br />The water impoundments (sediment ponds) are not intended as permanent constructions on the mine <br />site, but will remain intact until the site has been successfully reclaimed. <br />The diversion channels and buried culvert pipe will be maintained during the reclamation program <br />until Phase II Bond release has been achieved, <br />Upon successful Phase II Bond release, permanent drainages will be installed and the ponds <br />reclaimed. <br />Unneeded power and telephone line poles and equipment will be removed with the assistance of the <br />local public utilities at the time the King Coal Mine is abandoned. The well pumps will require power. The <br />surface owner has requested by letter, noted above, that power remains. <br />The Upper Facilities Area (Coal Stockpile to Bath house) will be ripped and the coaly waste will be <br />pushed to the highwall and buried. <br />SEALING MINE OPENINGS AND DRILL HOLES <br />In accordance with the requirements of our mine plan, 211.41 (c) 30 CFR, the portals (mine <br />openings or entrances into the King Coal Mine) will be back-filled and sealed against inflows of surface <br />water and access by animals or people. Coal stockpile residue on the permit area will be scraped from the <br />surface as described earlier and used for backfill inside the portals. This will limit acid-forming or toxic <br />materials in the final plant growth medium dispersion and re-vegetation. These four portals aze each <br />approximately 10 feet wide by 8 feet high. To fill them to a depth of 25 feet will require about 296 cubic <br />yards of material plus a small amount to account for sloughing at the inby end. Total portal backfill will <br />
