The design and controls proposed in the operation and the attached <br />Operation Standards will minimize impacts on surrounding uses and the <br />area to the breatest extent possible and provide adequate protection <br />of the health, safety, and welfare of the inhabitants of the area and <br />the County. <br />c. The proposed operation is in compliance with the provision of Section <br />31.4.1 of the Weld County Zoning Ordinance for Uses by Special Review <br />in the Agricultural District. <br />d. These determinations are based, in part, upon a review of the informa- <br />tion submitted by the applicant, other relevant information regarding <br />the request and the responses of the referral entities which have <br />reviewed this request. <br />The Weld County Planning Commission recommendation for approval is conditional <br />upon the following: <br />1. The attached Operations Standards being recommended and approved for <br />this request. <br />2. The following note being placed on the Special Use Permit Plat: <br />NOTE: The Mined Land Reclamation Board has the authority to <br />issue permits for mining and reclamation activities. Activities <br />related to mining and reclamation are, therefore, under the <br />jurisdiction of the Mined Land Reclamation Board; however Weld <br />County has ;urisdiction of those matters outlined in the Opera- <br />tion Standards. <br />3. The Operations Standards being placed on the Use by Special Review <br />Plat. The Use by Special Review Plat shall be delivered to the <br />Department of Planning Services. <br />4. Prior to the Use by Special Review approval by the Board of County <br />Co~mnissioners the applicant shall submit a revegetation plan using <br />perennial grass species and approved by Soil Conservation Service any <br />major change in the revegetation plan approved by the Mined Land <br />Reclamation Board shall be presented to the Department of Planning <br />Services staff for placement in the file record. <br />RA:bn <br />
