News and Infortnatian from the Colorado <br />• ion of Minerals and Geolow and the <br />~rado M1fined Land Reclamation Board <br />DMG Bulletin -- November X6,1998 . ~' <br />Colorado Mined Land Reclamation Board Hearing Process: <br />Typically, any application fora 112 Regulaz Operation permit or an amendment to a 112 Regular Operation permit <br />requires a hearing before the Mined Land Reclamation Board when there is a wrinen objection. However, prior to the <br />Formal Board Hearing, several other hearings must occur prior to the Formal Board Hearing. <br />The Informal Conference: <br />The First of the three hearings in the process is the Informal Conference. If there are objections~r at the request of the <br />applicant or local board of county commissioner -the Division will schedule an informal conference among the <br />parties. The Informal Conference is held after the close of the required comment period, which is about 50 to 60 days <br />from the date an application is considered filed with the Division. <br />The purposes of the informal conference are to: <br />• Explain the three hearing process to the parties <br />• Identify the issues <br />• Identify the parties <br />• Determine what issues have been resolved <br />• Determine if any parties want to withdraw <br />The Pre-hearing Comterence: <br />The second hearing is the Pre-hearing Conference. It can occur no sooner than ten days after the Division has made iu <br />recommendation to approve or deny the application for a permit or amendment. However, it must also occur at least <br />five (5) days prior to the Formal $oazd Hearing. The Pre-hearing Conference is usually conducted by a member of the <br />Mined Land Reclamation Board. The Division is required to mail its recommendation to all parties prior to the Pre- <br />hearingConference. <br />The purposes of the Pre-hearing Conference aze to: <br />• Recommend the issues the full Board should consider ' <br />• Determine the lists of witnesses and exhibits to be presented by the parties at the Formal Public Hearing <br />• Determine the amount of time each parry will have to make their presentations at the Formal Public <br />Hearing <br />• Prepare a Drag Board Ceder that will be used to conduct the Formal Board Hearing <br />The Forma{ Board Hearing: <br />The Formal Board Hearing must be held prior to the automatic approval date for the permit application or the <br />amendment. At the Formal Board Hearing, the fast order of business is for the Board to adopt the Draft Board Order. <br />Parties may object to the Draft Board Order and seek revisions. Once the Draft Board Order is adopted, the Formal <br />Board Hearing begins. <br />Cm occasion, an operator may have a consultant represent the operator or company. In order to represent the applicant <br />or operator, the Board and the Attorney General's Office have requested that consultants complete a notarized form of <br />designation.
