The following letter reiterates items discussed during our telephone <br />conversation of this day. <br />• Mr. Rick Mills, our Environmental Manager, and Gary Buchan, our Engineering Manager, were physically unavailable <br />to sign our DMRS for this period, which should have been mailed by Monday October 29th. On Tuesday, October 30, <br />Mr. Mill was available to sign these DMRS. I will forward the DMRS, via next day mail, which should have them <br />arriving to you sooner than had we used U.S. Postal on the 29th. <br />• During the 3rtl quarter, Outfall 001 X (Permit CO-36684) was inadvertently analyzed for the more stringent chronic <br />WET testing for two species this quarter, as opposed to newly required acute WET testing for one species. Future <br />quarterly samples will be analyzed for acute WET testing, as outlined in the revised CDPS that went into effect in <br />August 2001. TCC is hoping that this error will not be considered a deficiency, since the test ran was more sVingent <br />and still passed. <br />• Under DMR Permit CO-0042161, Outtall 001 X, page 1 second row, there is a listed limitation: "100.0001 MN Value", <br />for the WET test: "%Eflect Statre 7 Day, CHR CERIODAPHNIA TCP38 S 0 0". The value we reported for this <br />category is 75 %. In talking with our lab and reviewing the permit requirements, this WET test passed. The <br />100.0001 MN Value listed in the DMR may be in error, and as such, TCC did not record this as an exceedence on the <br />DMR. <br />Thank you for your time and input on these items.
