IBBUEB TO BE COlTBIDERED <br />Presentations to the Board shall be strictly limited to the <br />issue of whether the pending application complies with the <br />requirements of the Colorado Mined Land Reclamation Act and the <br />regulations promulgated by the Board. Specifically, presentations <br />shall be limited to the question of whether the pending <br />application should be deaied or limited on the basis of the <br />following consideration: <br />1. The necessity of importing topsoil for reclamation to <br />achieve the poet mining land use of wildlife habitat. <br />III. 1fIT8S66E5 A9D EIEIBITB <br />The Applicant or Objector may submit additional exhibits up to and <br />including September, 22, 1993, the data of the Formal Public <br />Hearing. 8xhibits shall be limited to the issue to be considered <br />as stated above. All documents, exhibits, and phetographa <br />presented as evidence at the hearing will become part of the <br />administrative record. <br />IV. PROCEDURE <br />The Division, Applicant and Objector shall make their presentations <br />in the following order. The time limits set out below are maximum <br />limits and shall be strictly enforced. The Board, in its <br />discretion, may allow additional time when warranted. The Board <br />hoe the right to limit any redundant testimony. Unused time may be <br />used in subsequent rebuttal or closing statements as applicable. <br />At the conclusion of each presentation, the other participants will <br />be afforded an opportunity to conduct cross examination of any of <br />the witnesses that testified during the presentation. <br />Division Introduction.
