Owner has initiated a separate agreement that it intends to enter into with willittg private <br />property owners. City will ask that these mitigation measures occur in a reasonable time <br />flame. <br />n) Land B~ruL: Owner has agreed to berm in areas where the gravel pit abuts residential <br />properties, as dictated by the noise study and when acceptable to adjacent property <br />owners (as shown on the Mining Plan). Betming will help ensure that visual impacts are <br />mitigated. <br />o) I-2 Industrial Zonine: The two parcels of land that amtain the concrete and asphalt batch <br />plants are the Yokooji and Watada parcels. These two parcels will be zoned I-2 <br />Industral. However, the Permit will not require that the Owner conduct either an <br />environmental assessment or an environmental impact statement. <br />p) Mining Operations: The City will not allow the Owner to commence mining operations <br />until the State of Colorado Department of Minerals and Geology has issued and approved <br />the MLRB 112 Reclamation Permik The City will require a copy of the approved permit <br />for its records. <br />q) Water Oualitv: The applicant shall monitor the quality of the groundwater in three on- <br />site wells near the perimeter of the property for a minimum of five years. <br />NOW, THEREFORE, BE IT RESOLVED that the Fort Lupton City Council hereby approves the <br />Special Use Permit as revised after submittal by SW TKO Joint Venture, LLC to operate a gravel pit <br />mina, two asphalt batch plants and a concrete batch plant im F-ert fupton, Colorado with the conditions <br />listed (a) through (q) herein. <br />APPROVED AND ADOPTED BY THE FORT LUPTON CITY COUNCIL THIS 2°" DAY OF <br />MARCH 2005. <br />City of Fort Lupton, Colorado <br />~~~~ <br />S.
