I refer to the <br />'Regulations of the Colorado Mined Lana Reclamation Board for Coal Mining' rule 4.Ob.13(1) <br />Ground Wetar, part a) which states that: <br />'Groundwater levels, infiltration rates, subsurface flow end storage <br />Characterlstlcs, and the quality of ground water shall be monitored in e <br />manner aooroved by the Divisio0,after consultation with the Division of <br />Water Resources ....' (emphasis sdded-. <br />The Division of Water Resources In correspondence with you end DMG has provided <br />information regarding monitoring end observation walla permitted end regulated by DWR. <br />1 believe that DMG'a authority supersedes DWR'8 by virtue of this rule as well as 3.2 of <br />pWR's Water Wall Constructlon Rules if DMG chooses to Impose Its own rules in lieu of those <br />of DWR rogerding monitoring and observation wells.
