Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology has completed review of the 2004 quarterly reporting <br />submitted for sediment ponds, discharge monitoring reports, and waste pile at the Southfield <br />Mine, #C-81-014. Please consider our comments and make any necessary changes or <br />adjustments in future reporting to the Division. <br />Discharge Monitoring Reports (DMR) -The DMR's submitted and reviewed reflect observations <br />consistent with Division monthly inspections. No discharges from any of the ponds were <br />observed and/or sampled. <br />Sediment Ponds Inspections- Four sediment ponds are inspected quarterly at this site, pond 4 <br />and pond 5 at the main facility area, and pondsl and 2 at the coal loadout. Each inspection <br />report demonstrates compliance with Rule 4.05.9(17) for impoundments. However, please be <br />more specific when referring to the water level as related to the primary risers at these ponds. <br />For example, in the 2"d quarter at pond 5, the report states "water level is approximately 1.5 feet <br />below the primary riser. Primary is closed." Is the water level 1.5 feet from discharging through <br />the top of the riser or is it 1.5 feet below the bottom of the riser as it meets the embankment? <br />What does primary is closed mean? A dewatering gate is located at the bottom of the primary <br />riser but this gate was originally installed for manual dewatering only. It is now welded shut and <br />the control rod is broken off at the gate. <br />Depth and elevation of any impounded water and the existing storage capacity for both sediment <br />and water were noted in the 4~" quarter reports. A registered P.E. has also certified the 4th <br />quarter reports. In future annual certifications, please add the language that states that the <br />"impoundment has been...maintained as designed, and in accordance with the approved plan <br />and the applicable regulations." Please refer to Rule 4.05.9(14) and (15). This statement should <br />be added to each report for the annual inspection to comply with these two Rule requirements. <br />Waste Pile Inspections - The four quarterly reports meet the requirements under Rule <br />4.09.1(11) and 4.10.2(2). We have no further questions or comments at this time.
