The issuance of the permit does <br />not assure the appllcara that no injury will occur to another vested water right or preclude another owner of a vested water right <br />from seeking relief in a civil court action. <br />2) The construction of this well shall be in compliance with the Water Well Construction and Pump Installation Rules 2 CCR 402-2, <br />unless approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump <br />Installation Contractors in accordance with Rule 17. <br />3) Approved pursuant to CRS 37-90-107 and the Mdings of the Ground Water Commission dated January 27th, 1993 and minutes <br />of the March 3, 1992 meeting of the North Klowe-Bijou Ground Water Management District. This permit i4lssued as a corrtactlon <br />of pennd no. 4201&F Issued on January 27, 1993 and as such supersedes and expires the same. <br />a) The maximum pumping rate shall not exceed 50 GPM. <br />5) The annual appropriation shall not exceed 72 acre-feet. <br />6) The use of this well is limited to commercial use In a gravel mining operation, commercial use in a hunting dog kennel, domestic <br />use for one residence, livestock use, irrigation of 11.5 acres in the SE1/4 of the NW1/4 and the SW1/4 of Sec. 1, Twp. 3 South, <br />Rng. 63 West, the 6th P.M., and, pending approval of a replacement plan, replacement water for a gravel mining operatfon and <br />four alluvial ponds. <br />~ At least 4 percent(4%) o! the water withdrawn annually Irom this well shall be returned to the uppermost aquifer <br />8) Tho well mus! bu constl u~red tc •xi'hd;:tvr water from only he Up;,e Aranat oe aquifer. Plain casing must be installed Irom the sudace to a depth of 1 foot below the top of the <br />Upper Arapahoe Aquifer and sealed to prevent diversion of water from other aquifers and the movement of water between <br />aquifers. <br />9) This well shall be constructed within 200 teat of the location specified on this permit. <br />10) The entire length of the hole shall be geophysicaly logged according to the attached instructions prior to installing the casing <br />and submitted to the North Kiowa-Bijou Ground Water Management District and the Division of Water Resources. <br />11) A totalizing Ilow meter must be installed on the well and maintained in good working order. Permanent records of all diversions <br />must be maintained by the well owner (collected at least monthly) and submitted to the Nonh Kiowa-Bijou Ground Water <br />Management District and the Division of Water Resources on an annual basis on or belore January 15 of each year. <br />12) The owner shall mark this well in a conspicuous place with the permit number and the name of the aquifer.
