Cattany <br />Trinidad, CO 81082 Ailing Division Director <br />RE: M-2002-109, Adequacy Review. <br />Dear Mr. Blasi <br />The Division contacted you over the phone regarding the above mine pending <br />application, on 12-16-02, but did not receive a return phone call. Since the decision date <br />is 12-26-02, the adequacy items will have to be resolved before that time. <br />(I) EXHIBTT A <br />(!) The operator states under the general operation information, the permit area to be 9.5 <br />acres. However, under the legal description, the total affected acreages add up to 9.97 <br />acres. All the maps provided indicate, total permit acreage of 9.98 acres, and please <br />explain. <br />(In EXHIBIT B <br />(1) The operator states, the only man made structure with in 200 hundred feet of the <br />mining area, to be a fence owned by the State Land Boazd. What will be the closest <br />distance between the pit wall and the fence along the North West corner? Unless the <br />operator can demonstrate or provide an agreement with the fence owner, the Division <br />requires a minimum of fifty feet separation. <br />(II) EXHIBIT C <br />(1) Under sub-heading (a) the operator states, the estimated starting date to be <br />November 2, 2002. The application was submitted on November 6, 2002. It is <br />important for the operator to know that no portion of the permit area can be affected <br />until the Division issues a permit. <br />(2) Under sub-heading "d", the operator states, "mining will not be commenced with in <br />two feet of the water table.
