' L 4. On July 23, 1992, a representative of Trinidad' Basin met with representatives of the Division to discuss the discharge of June 29, 1992. As a result of the meeting, Trinidad Basin agreed to apply fora CDPS permit to regulate discharges from the sediment ponds. During the meeting, the representative from Trinidad Basin was informed that a permit could not be issued until the outstanding balance for past permit fees was paid. 5. The Division received a permit application on July 23, 1992. To date, the outstanding balance for permit fees has not been paid and a discharge permit has not been drafted. 6. On July 29, 1992, representatives of the DMG inspected the mine. A discharge was observed from pond 15-P2 into the Del Aqua Arroyo. A sample of the dischazge was collected and analyzed. The results of the analysis showed the following level of pollutants: Pollutant Concentration Total Suspended Solids, mg/1 780 Settleable Solids, ml/1 >40 Iron, mg/1 77 pH, s.u. 7.2 7. On July 29, 1992, representatives of the DMG inspected the mine. A dischazge was observed from pond 15-P1 l into the Del Aqua Arroyo. A sample of the dischazge was collected and analyzed. The results of the analysis showed the following level of pollutants: Pollutant Concentration Total Suspended Solids, mg/1 2210 Settleable Solids, mUl >40 Iron, mg/1 48 pH, s.u. 6.7 8. On August 19, 1992, representatives of the DMG insetted the mine. A discharge was - observed from pond 15-P10 into the Del Aqua Arroyo. A=sample of the discha'rgt~as collected and analyzed. The results of the analysis showed the following level of pollutants: Pollutant Concentration Total Suspended Solids, mg/l 110 9. Discharges from the ponds contain pollutants as defined by 25-8-103(15), C.R.S. (1989 Repl. Vol. 11A and 1992 Supp.). 10. The Del Agua Arroyo is "state waters" as defined by 25-8-103(19), C.R.S. (1989 Repl. Vol. 11A and 1992 Supp.).
