' ,',' 1 I • <br />BOOK S66 PACE282 <br />GRANT, CONDITIONS AND AGREEMENTS <br />The Board, in reliance upon the representations and <br />promises made in such application, as amended, hereby issues <br />a life of the mine permit to Exxon Corporation as operator, <br />to engage in the underground mining and surface operations <br />described in the application on the lands described in <br />Exhibit I hereto, subject to the following conditions and <br />agreements: <br />1. This permit is issued subject to, and the operator <br />agrees to be bound by, all lawful requirements of <br />the Act and all lawful rules and regulations of <br />the Mined Land Reclamation Board, as amended from <br />time to time. <br />Due to the uncertainty as to the final disposition <br />of the Davis Gulch and Middle Fork dams and the <br />impact these structures may have on reclamation, <br />the operator will notify the Division of its <br />proposed disposition prior to taking action in <br />this regard. As to the lands comprising such dams <br />the operator will, upon the termination of mining <br />and processing operations at the site: (a) reclaim <br />such lands; (b) maintain such dams; or (c) convey <br />all of operator's rights (exclusive of water <br />rights) in such lands and dams. If reclamation is <br />to be undertaken, the operator will submit a plan <br />for such reclamation which describes the manner <br />and method of soil and sediment removal, revegetation, <br />reconstruction of the stream channel and a depiction <br />of the post-reclamation topography. If the operator <br />proposes to maintain the dams, plans for their <br />operation and maintenance will be submitted to the <br />Division for review. Prior to the release of the <br />sureties provided to insure reclamation, if either <br />or both of these facilities shall be sold or <br />otherwise conveyed to a third party not an operator, <br />the operator will provide the Division with the <br />identity of the transferee or purchaser and a <br />summary of the terms of the transfer or sale. <br />3. The operator will, when expressly required by the <br />application or requested by the Division, submit <br />its proposed monitoring programs, design plans and <br />specifications relevant to the reclamation operation, <br />and plans for reclamation, to the Division. The <br />Division shall within ten calendar days of receiving <br />any such documents notify the operator if the <br />Division wishes to conduct a detailed review of <br />said submittals. Upon the giving of written <br />notice o~ said desire to the operator, the Division <br />shall have no more than thirty calendar days after <br />the receipt of said information to review and <br />comment thereon. If no comments or objections are <br />directed to the operator within thirty calendar <br />days, the plan or program shall be deemed approved. <br />If any such comments or objections are received <br />from the Division, the operator will be obligated <br />to respond to said comments or objections. The <br />Division may recommend or suggest revisions of or <br />supplements to said program or plans. The operator <br />will, however, reserve the sole right to develop <br />the scope and extent of the details of said design <br />plans and specifications. <br />-2- <br />
