Rule 2: Permits <br />Due to the proximity of the Primero Middle/High School and local residences, LCC will record <br />the level of airblast generated from each blast, and maintain copies of these airblast records in <br />accordance with Rule 4.08.5(17). The airblast recording system will be established in the <br />Primero Middle/High School parking lot neazest the blasting. The upper-end and lower-end <br />frequency limits of the airblast monitoring system will be 250 and 2 Hz, respectively. <br />Owners of residences or structures located within''/z mile of the permit boundazy will be notified <br />of the blasting and offered the opportunity to receive pre-blasting surveys. Exhibit "B" on pages <br />2.05-39e and 2.05-39f is a copy of the notification to be sent annually. LCC will conduct pre- <br />blasting surveys of surface structures upon request by the Division. No blasting will be <br />conducted within 1000 feet of dwellings, schools, hospitals, churches, or nursing homes without <br />prior approval from the Division. Table 2.05.3-3 lists the names and addresses of the residents <br />and owners of dwellings and other structures located within one-half mile of the LCC permit <br />boundazy. <br />At least once each year, Lorencito agrees to initiate the following actions to maintain accurate <br />property ownership records for lands located within one-half mile of the Mine Permit Area. <br />(a) examine the Las Animas County Tax Assessor's records covering ownership of real property <br />located within one-half mile of the mine Permit Area and copy all data covering a change in <br />the ownership information since the last examination was conducted; <br />(b) visit the azea within one-half mile of the Permit Area to determine if any new construction or <br />renovation has occurred since the last visual survey; <br />(c) record and maintain records showing when the examination of the tax assessor's records and <br />the visual survey of the azea within one-half mile of the Permit Area occurred. This <br />information shall be maintained in a sepazate file covering real property ownership changes <br />that occur within one-half mile of the Permit Area. <br />Rule 4.08.4(8) concerns limiting flyrock from blasting to '/z the distance to the nearest residence <br />and/or the property boundary. The nearest residence to mining is neaz Contour Mine Area P2, <br />approximately 1,200 feet away. The property boundary is approximately 50 feet from the <br />northernmost boundazy of P2. In those azeas where blasting cannot be designed to control <br />flyrock according to the rule, LCC will either not mine the azea, or will use dozer ripping or <br />other non-flyrock methods to break rock and coal. <br />As shown on Map 2.05.3-5, there aze several coal-bed methane wells and pipelines within 500 ft <br />of permitted blasting azeas. Table 2.05.3-4 shows the date each coal bed methane well within <br />500 ft of proposed blasting was completed (based on well records maintained by the Colorado <br />Oil and Gas Conservation Commission). <br />According to Paragraph 15 of Exhibit B of the OIL AND GAS TOP LEASE, dated June 22, <br />1998, between MGP Enterprises (MGP) and Evergreen Resources, Inc. (Evergreen), Evergreen <br />must suspend operations, shut in wells, and relocate gathering systems upon 120-day notice from <br />LCC that its operations aze coming within 500 ft of their facilities. All coalbed methane facilities <br />such as wells, wellheads, pipelines, and other associated facilities will be removed before <br />blasting operations occur within 500 feet of them.
