If previously unplanned surface <br />disturbing activities, not approved as part of Permit No. C-005-80, <br />are necessary in the unsurveyed areas as designated on Exhibit "5-1", <br />Seneca Coals, Ltd. will submit a cultural resource survey and a <br />description of the proposed disturbance for approval prior to the <br />• commencement of these activities. If cultural resources are located <br />that are potentially eligible for the National Register of Historic <br />Places, Seneca Coals, Ltd. in consultation with SHPO and other <br />applicable state and federal agencies, will develop a testing plan <br />for the site(s).
