MLRB Permit Application #78-52 Response to Tanabe Objections Gentlemen: We are responding to Mr. Don Tanabe's letter of objection dated April 19, 1978, and postmarked May 8, 1978. Our response will answer each of Mr. Tanabe's six objections in order. 1. There will be no pumping out of water to lower the water table. Therefore, no irrigation wells will be affected. 2. If the sand pile referred to is the overburden pile along the north line, we point out that since we have taken possession of this property we have spent a good deal of time and money reducing the size of this pile. We plan to seed what is left of this overburden pile so as to minimize any possible blowing. 3. We will conform to both Adams County and EPA noise regulations. 4. Adams County has specified the working days and hours when this pit may operate. 5. Our mining and reclamation plans both show that we have used a 25-foot setback from our property line as set out in the County Zoning Regulations 3.623, sub-paragraphs 2 and 3. Our property line was determined in a survey by Mr. Jasper Freese, L.S. No. 4392. 6. Insofar as we could determine by a search of the Adams County records, we have notified all owners of record. In the last paragraph Mr. Tanabe claims that he was not notified. Our letter to him was mailed by certified mail on March 20, 1978, and a D. Pi. Tanabe signed the receipt for certified mail number 527901 on March 22, 1978. The Division was mailed a copy of this receipt shortly thereafter.
