(LRM), we are requesting your approval of <br />the use of leased Colorado-Big Thompson (C-BT) water for the Larimer Pit (MLR No. M-74-069) <br />substitute water supply plan (SWSP). <br />On May 16, 2006, you approved our request for use of leased water in LRM's 2006 SWSP. LRM is in <br />the process of applying for their 2007 SWSP in which they will again need your approval to use leased C- <br />BT units. This will be their second year ofthe £ve year allowable use of Project water. LRM has secured <br />a lease of C-BT water with the City of Loveland. The attached lease provides LRM with a total of 67 ac- <br />ft based on a need for 33.16 ac-ft net depletion, a return flow protection factor of 100% of the net <br />depletion, and no river shrink (per conversations with the water commissioner). We have also included a <br />copy of the January 11, 2007 S WSP and the January 30, 2007 revision which specifically outlines our <br />anticipated use of the credits (see Table 5). <br />Based on our understanding of the interim rule, we believe that this lease and use of C-BT credits should <br />be acceptable to NCWCD. Before approving LRM's S WSP, the State requires a letter ofapproval for the <br />use of these C-BT credits from NCWCD.
