Listed below are [he Division's adequacy ~" <br />review comments for this application. The Division is required to make a recommendation to the Mined Land Reclamation <br />Board no later than August 29, 2002 therefore, your response [o [he following adequacy review concerns should be <br />received by [he Division by August 22, 2002. <br />1. In Exhibit D page 2 i[ is stated that Moffat County may put an asphalt batch-plant onto the property for neighborhood <br />paving projects. Please describe [he measures which will be taken to prevent any contamination of surface or ground <br />waters from any spilled asphalt materials during the operation of the batch plant. <br />2. , A wildlife statement was included as Exhibit H-3. Item 4 of [his statement states that "Impacts will be minimal <br />provided that the mining operation stays outside of the 100 year floodplain of the Yampa River." It appears from the <br />application [hat this will be the case, please commit to keeping the mining operations out of the flood plain. <br />3. Item 5 of the wildlife statement recommends that the seed mix be modified by replacing [he intermediate wheatgrass <br />with bluebunch wheatgrass, slender wheatgrass, and/or needle and thread. <br />4. The Division concurs with this recommendation, and suggests Iha[ [he intermediate wheatgrass be replaced with 2 <br />pounds Pure Live Seed (PLS) per acre of Needle-and-thread and 3 pounds PLS per acre of slender wheatgrass. The <br />Division recommends that the applicant commit to this modification of the seed mix . <br />Pleased be advised [ha[ [he Sunbeam Pit #1 I12 (c) Application maybe deemed inadequate, and the application may be <br />recommended for denial on August 29, 2002 unless [he above mentioned adequacy review items are addressed [o the <br />satisfaction of the Division. If you feel that more time is needed to complete your reply, [he Division can grant an <br />extension to the decision date. This would be done upon receipt of a written waiver of your right to a decision by August ~~ <br />29, 2002 and a request for additional time. This must be received no later than the deadline date.
