i III IIIIIIIIIIIIIIII ~ <br />RESOLUTIOP7 <br />RE: APPROVAL OF SPECIAL USE PER~SIT FOR AN OPEN CUT DSINE - TUCKER <br />CONSTRUCTION COMPANY, 4563 EAST COUNTY ROAD #68, WELLINGTON, <br />COLORADO 80549 <br />WHEREAS, the Board of County Commissioners of [veld County, <br />Colorado, pursuant to Colorado statute and the Weld County Home <br />Rule Charter, is vested with the authority of administering the <br />affairs of Weld County, Colorado, and <br />fvHEREAS, the Board of County Commissioners of Weld County, <br />Colorado held a public hearing on the 17th day of Diarch, 1980 at <br />the hour of 9:00 a.m. in the Chambers of the Board of County Com- <br />missioners for the purpose of hearing the application of Tucker <br />Construction Company, c/o Lee Tucker, 4563 East County Road #68, <br />Wellington, Colorado 80549, for a Special Use Permit for an <br />open cut mine operation on the following described real estate, <br />to-wit: <br />A tract of land located in Township_ ~11 <br />North, Range 67 [vest, [veld County, Colo- <br />rado, more particularly described as <br />follows: Section 17 all (except .229a <br />AT & T in the Southwest Quarter, South- <br />west Quarter) Section 20 North Half North- <br />east Quarter. <br />WHEREAS, the petitioner was Present, and <br />WHEREAS, evidence was presented in support of the granting <br />of the Special Use Permit for an open cut mine operation on the <br />above described real estate, and <br />WHEREAS, Section 3.3(E)(2) of the Weld County Zoning Resolu- <br />tion authorizes such a use in an Agricultural District upon appro- <br />val by the Board of County Commissioners, and <br />[vHEREAS, the Board of County Commissioners of Weld County, <br />Colorado heard all of the testimony and statements of those pre- <br />sent, has studied the request of the petitioner and the recommenda- <br />tions of the [veld County Planning Commission and all of the exhibits <br />and evidence presented in this matter, and having been fully <br />informed, is satisfied that the request for a Special Use Permit <br />r <br /> <br />
