Mrke Sherman (Field Habitat <br />Biologist) and BiU Oht>stead (Dish~ict Wildlife Manager) have reviewed this Reclamation Permit Application <br />Consideration and rttade a 5ek1 visit to the proposed amended mine site on May 10, 2000. <br />Most of the proposed minutg project w1~Il rot negatively impact wr7d(!te and/or wildh'fe habitat in a negative <br />fashion. The occurrence ofbank swa0ow tttstrtts cavities in the hear vertical side ofsard stockpiles is <br />nterttioned in Exlubit H (Wildlife Information) of the application. We also observed active nesting cavities in <br />several of the stockpiles located around the current process'vtg plain. We highly recommend that if any of <br />these stockpiles are going to be dicturbed/moved that this occur outside the nesting season and thus between <br />August I5 and April 30, as referenced in the Colorado Breeding Bird Atlas (Hugh ICmgery, EdJ. <br />'the swallows are highly susceptible to being buried and killed in then nesting cavities by <br />duturbing/moving the stockpiles during the nesting season. All bird species are protected by the law and <br />killing one is illegal. <br />Additionally, we [ecotrmterd that the applicazn inchide a l»ttiol~ wced control program during the l'de of the <br />openrtion and post completion. Disttubed areas within tninit>s opetatiotu are especially suscepuble to weed <br />invasion. We observed numerous stockpiles on the site that contained estabfishulg noroous weeds. <br />As always, it u suggested that care be taken during rninitig to avoid eYrpea erosion, siltation, or disttabance of <br />more land than necessary to accomplish the project.
