As a follow-up to our conversation eazlier today by telephone, in reference to the item captioned above, I wish to
reiterate several items which should be made part of your request to the Mined Land Reclamation Boazd that they
approve your pemut application.
Your application was approved by Division staff on January 1, 2002. Due to certain delays, the financial warranty
was not posted until early 2003, a delay of more than 365 days afer application approval. Pursuant to Rule 4.1(2),
the decision on the application must be made again, the second time in a hearing before the Mined Land
Reclamation Boazd. You may request a hearing on this matter. One will be scheduled for the August agenda by
submitting your request to the Division before July 28, 2003.
The request should include your name (or whomever you designate to represent you), operator name, site name, file
number, purpose of request for hearing ("to obtain Boazd approval of 110(2) permit application, due to the bond
being posted after the 365`s day after staff approval of the application"), and possibly a brief statement explaining
why the delay occuFred. You should also point out that no permit-related disturbance has occurred on the permitted
site, and no permit conditions have changed.
The August Boazd meeting will begin at 10:00 a.m. on Wednesday, August 20, 2003, in Denver, Colorado. For this
type of item, I do not believe it will be necessary for you or a representative to be present, if as you state, no onsite
activity has occurred. If no one is there representing you, it will be necessary that your written request is cleaz,
even though it may be brief. There is no fee to have your item placed on the agenda or heard by the Board.
