Long <br />Drvisian Director <br />Re: Agri-Cal #1, File No. M-97-064, Receipt of 110(2) Hard Rock/Metal Mining <br />Reclamation Permit Application Package <br />Dear Mr. Vestal: <br />On July 2l, 1997, the Division of Minerals and Geology received your the 110(2) Hard Rock/Metal <br />Mining Reclamation Permit Application package for the Agri-Cal #1, File No. M-97-064. <br />Preliminary review of the information received determined that the following items must be received <br />before the Division can consider your application as being submitted and technical review can begin: <br />I) APPLICATION FORM: The preliminary application review has determined that your <br />commodity-type and end use should be regulated under the Hazd Rock/Metal Mining Rules <br />and Regulations, CRS 34-32-101, et seq., rather than the Conswction Materials Rules and <br />Regulations, CRS 34-32.5-101, et seq. As a result of this determination, the form you have <br />submitted is the incorrect application form. Please complete the Hard Rock/Metal Mining <br />application form which has been provided for you. Also included with this package are the <br />correct Rules and Regulations, provided at no cost to you. <br />Please be sure to complete all blanks. In order to simplify your task, somewhat, we will <br />accept and use pages 4-6 of your original application form. I am resuming one partial <br />original copy of your application for your reference. <br />Item 3 -Permitted Acreage: Because you are submitting a Limited Impact 110 Operation <br />application, the maximum acreage allowed, under the Law is 9.9 acres. This number may <br />not be rounded up, nor should your actual disturbed acreage exceed this number. Please use <br />the correct figure. Additionally, please be aware that because your lease includes acreage <br />which far exceeds the maximum allowed by a 110 operation that you should carefully <br />observe your permit area markers so as not to mine beyond those boundaries. <br />2) EXHIBIT E -Map (Rule 6.3.5): (I} in addition to the requirements of 6.2.1(2), you must <br />provide a map that clearly describes the features associated with the mining plan and the <br />components of the Reclamation Plan. Include one map for the mine plan and one map for <br />the Reclamation Plan. The map(s) must be drawn to a scale no smaller than appropriate to <br />clearly show all elements that are required to be delineated by the Act and these Rules; show <br />a north arrow, note any section comers adjacent to the proposed operation, and indicate the <br />date illustrated.
