Vandiver <br />Drvis~on Engineer <br />r~_ 83- l7,~ <br />Our office has received a copy of the May 7, 1996, field inspection report of Mr. James Dillie of the <br />Colorado Division of Minerals and Geology, regarding the Alamosa Pit No. 2. In this report, it is <br />stated that a well permit has been obtained from our office to replace out-of-priority consumptive <br />use from evaporation off of the exposed water surtace. <br />A review of our files does not stlow that such a well permit was ever obtained. We also cannot find <br />any evidence of an approved Substitute Water Supply Plan or a court approved plan of <br />augmentation which covers this mining operation. Please contact our office by July 12, 1996, to <br />discuss this situation. ' <br />Colorado statute 37-90-137(11)(a), C.R.S., requires any gravel pit which exposes ground water to <br />the atmosphere after December 31, 1980, to replace all out of priority depletions of ground water. <br />These depletions are caused by evaporation from the exposed water surface area. In the area <br />where this pit is located, the ground water system is considered over appropriated and this statute <br />applies. Failure on your part to contact our office by the above mentioned date may result in our <br />taking additional steps to gain compliance and may include legal action. <br />I have enclosed a copy of the draft guidelines that our office has developed for substitute water <br />supply plans for sand and gravE:l pits. 1 suggest you review this document as it may be helpful in <br />understanding what may be required of you to comply with the law. <br />Sincerely, ~y~, ~~~ <br />Robert M.
