Cattany <br />Division Director <br />The Division of Minerals and Geology has reviewed the sediment pond report for the 1st <br />quarter 2003 submitted by Greg Lewicki and Associates for the Rimrock mine. The inspection <br />was delayed until early April due to a late March record snowstorm in the region. <br />The report complies with the requirements of Rule 4.05.6(13) for inspection of sediment ponds <br />at coal mining sites. Generally, the pond holds water only for limited periods after storm runoff <br />events. Adequate sediment and water storage capacity, spillway function, and embankment <br />stability was noted. Mr. Lewicki noted no remarkable observations. Based on our independent <br />observations during field inspection we concur with the observations as noted. One exception <br />is the observation of excellent vegetation on the pond embankment. Most perennial species on <br />the embankment seem to be annual weeds of various varieties. Although stability does not <br />appear to be jeopardized, the long-term stability of the embankment would be improved by <br />better establishment of grasses and forbs similar to the reclaimed area. <br />We have no questions regarding this report.
