I have also en- <br />closed acopy of technical revisions to the original permit #81-165, namely the abolition of cyanide <br />agitation leaching. No cyanicle will be stored or used anywhere in the new process. If this needs <br />to be stated in an application, could you please forward the appropriate application to the address <br />noted below in this letter. <br />I feel that these technical revisions clearly demonstrate that the mining operation should not be <br />classified as a designated mining operation. This was based on of the definition given in Mineral <br />Rules and Reoulations on page 4. "Metal mining operations, permitted under Section 34-32-110, <br />C.R.S. 1984, as amended, which do not use or store designated chemicals, shall be exempt from <br />the requirements applicable to Designated Mining Operations, unless they have a potential to <br />produce acid mine drainage in quantities sufficient to adversely affect any person, property or the <br />environment. It shall be the burden of the Operator or Applicant to demonstrate to the satisfaction <br />of the Office that such potential does not exist " All the chemicals mentioned in the technical <br />revision will not impact the em~ironment. If need be, I can provide a letter from a local laboratory <br />certifying that the chemicals we intend to use are environmentally sound. <br />A financial warranty of $7000 has already been submitted.
