Beverlin, a certified professional engineer in the State <br />of Colorado, offer the following certification for the Edna Mine's <br />Moffat area sediment pond. <br />This certification satisfies requirements found in Rule 4.05.6(11)(a) <br />of the Regulations of the Colorado Mined Land Reclamation Board for <br />Coal Mining. The pond is located in the area specified in Exhibit <br />4.6-3 of the Edna Mine permit (#C-80-001). <br />The construction (excavation and filling) of the pond was observed, by <br />me, on a daily basis. Checks were made for bedrock control, <br />compaction on the dam embankment, grade control and rock placement for <br />rip-rap. The bulk of the construction took place between June and <br />August of 1990 and final rip-rap placement took place in April of <br />1991. <br />Slight grade differences were incorporated during construction to <br />accommodate for bedrock elevation variance not found during core <br />drilling of the area. The pond has minimum storage capacity outlined <br />in section 4.6.1.3 and supporting appendices of the Edna Mine permit. <br />I certify that the Moffat Area sediment <br />my knowledge and ability, with prudent <br />that the pond is in compliance with all <br />regulations and exceeds minimum design <br />approved Edna Mine permit (#C-BO-001). <br /> <br />pond was built, to the best of <br />state of the art methods and <br />applicable state and federal <br />criteria set forth in the <br />C~J_ <br />David L.
