Simpson
Stare Engineer
In 1989, the Colorado Legislature passed Senate Bill 120 which requires any gravel pit
in operation after December 31, 1980 that exposed ground water to the atmosphere after
December 31, 1980 to replace all water lost from the local stream system. It also requires that
well permits and substitute water supply plans or Water Court augmentation plans be obtained
for these pits.
As delegated through legislative intent, this office is in the process of determining which
gravel pits expose ground water and which do not. We may have sent you a letter requesting
this information previously, but our records indicate that we have not received a response.
Our office considers a pit to expose ground water if it has water in it for any part of the
year that is not the result of direct surface water diversion into the pit. In addition, if the pit has
to be continually dewatered, we consider it to expose ground water. The Colorado Division of
Minerals and Geology recently provided our office a copy of a report of a February 2, 1995 field
inspection of the above referenced pit indicating that this pit does expose ground water.
If you claim this gravel pit does not expose ground water, or the exposure occurred prior
to December 31, 1980, please provide documentation of this claim. If the gravel pit has exposed
ground water after December 31, 1980 the you have the following responsibilities:
A gravel pit well permit application and the associated $60 filing fee must be
submitted to the Colorado Division of Water Resources.
2. A substitute water supply plan to replace all water lost to the affected stream
system must be filed with the Colorado Division of Water Resources. The filing
fee associated with this plan is $1,343.
`J
a ~II ~I ~II ~II ~~~~~ ~I ~
999
OFFICE OF THE STATE ENGINEER
Division of Water Resources
Depattment o(Natural Resources
1313 Sherman $treel.
