Box 597 <br />Meeker, CO 81641 / / / <br />Re: Russell Ranch Pit, IIOc Application No. M-2006/008, New Decisio/n Date and request for <br />additional information. <br />Dear Mr. Rogers: <br />The Division of Minerals and Geology has received Russell Ranch's amended maps that include the <br />haul road. As discussed, staff is under the understanding that the Public Notice was published <br />yesterday. Please confirm for staff the date of publication so that the last day for comments can be <br />established. Per the Rules, the amendment of an application starts the review process anew. Therefore, <br />the new Decision Date is April 14`h, 2006. Should all issues be addressed prior to that date and no <br />additional comments aze received staff may issue a decision anytime after the public comment period is <br />complete. <br />Staff has received a phone call from and adjacent landowner. Unfortunately, staff failed to write the last <br />name of the person down. The caller stated that the proposed haul road entrance was within 200 feet of <br />his property line. Please verify to staff if this is correct. If so, Russell Ranch must notify the landowner <br />per Rule 1.6.2(e)(ii). <br />The maps that are supplied with the amendment need some additional information. <br />1) Please refer to Rule 6.2 for all requirements regarding the submission of maps. <br />2) The Division needs a map that clearly shows the entire haul road from the access point to the <br />permit area in its entirety that is of the same scale as the Mining Map and Reclamation Maps. <br />The map should clearly define the position of the road in relationship to any property lines. <br />3) If the haul road is within 200 feet of another property owner as claimed, the Rules require that <br />that person(s) be identified on the Exhibit A Map and Noticed by certified mail. <br />4) Please indicate on the Reclamation Map a general slope direction for drainage off site. <br />5) All maps should have a scale that allows staff to gauge distances for bonding calculations and <br />permit to property lines. <br />6) Staff during the site inspection, specifically noted the irrigation water ditch that is a manmade <br />feature which the haul road impacted. The new maps do not depict this feature. <br />7) The irrigation ditch should be included in Exhibit L. Details for the protection of the ditch <br />should be included in the Mining Plan.
