<br />Deer Creek Quarry, Inc. <br />MLRB Permit Application <br />February 20, 1997 <br />EXHIBIT D-- Mining Plan <br />The property has been mined, as a quarry since the late 1960's. <br />It was permitted at the Jefferson County level prior to the existence <br />of the MLRB permit requirment. At all these times, up until the present. <br />Henry and Doug Hall were owners. The Jefferson County permitting was <br />updated in 1982 with a life of the mine status under a special exception <br />which continues to be current today, and grants the Halls the right to <br />mine their property, subject to Jefferson County terms, conditions, <br />and standards incorporated in the Jefferson County documents. <br />Currently, the property has a perfected MLRB permit, #79-214/HR, <br />which is granted to Rocky Mountain Rock Products, a wholly owned <br />company of Western Mobile or Western Paving Construction Co. <br />The intent of this application is to permit the property to the Halls, <br />the owners of record, so they can enjoy the highest and best use of <br />their property. This permit application is based on standing information <br />currently of record and incorporated in the existing permit. <br />The documents incorporated within this Exhibit include all correspondence <br />and maps supplied by Lachel Associates to the MLRB under permit 79-214/HR <br />which address current conditions, benches, topo info, highwalls, etc. <br />together with a current technical revision granted within the old permit <br />that establishes the existing highwalls, and the acceptance of their <br />dimension and stability by the MLRB staff. <br />The most current documents submitted herewith, including the latest <br />highwall Technical Revision under #79-214/HR, shall incorporate our <br />current mining plan for the purpose of this application <br />
