^^ Banks and Gesso, LLC
^^
October 26, 2004
Colorado Division of Minerals and Geology
1313 Sherman Street, Room 215
Denver, Colorado 80203
RE: Attached 112 Permk Application
MMRR Rock Quarry, Gilpin County, Colorado
For: Clear Creek District Water Providers, LLC
To Whom it May Concern:
720 Kipling St.,Suite117
Lakewood, Colorado 80215
(303)274-4277
Fax (303) 274-8329
www.banksandgesso.com
RECEIVED
OCT 2 8 2004
Division ~f Minerals and Geology
Enclosed please find a completed application package for the above referenced project.
There are several items of note:
The entire property is owned by Phillip and Kathleen Wolf and it consists of one
{arge parcel of approximately 522 acres and a smaller parcel of approximately 4
acres on the southwest side of holding. We have provided a current title
commitment for the larger parcel and, since the smaller parcel was purchased in
April of this year, a copy of the Warranty Deed for that parcel.
The Wolf's own the entire property under this application and also hold all of the
original patent rights to include all mineral deposits.
There are only three man-made structures within 200 feet of the disturbed area
as planned. It is important to note that the 3 structures are within 200 feet of the
access road only and not within 200 feet of the actual mine area. There are no
structures within 200 feet of the mine area. We have begun the 200-foot
not cation and agreement process and will submit these as soon as they are
completed. The structures include CDOT owned Colorado Highway 119, Public
Service Company power and telephone lines, and a sewer line that is under
construction owned by the Blackhawk Central City Sanitation District. Since
these agreements or the alternative engineered slope stability analysis are not
completed as of this time we have included a signed affidavit by the applicant
that no disturbance will take place until the agreements or slope stability analysis
are completed and approved by the DMG.
Please also note that the applicant, Clear Creek Water Providers, LLC is a limited
liability company and not a corporation. Therefore there is no corporate secretary nor a
corporate seal. Mr. Lembke is the only manager of the LLC and he has signed the
application.
