<br />3. Rule 6.4.4(f)(ii) -you must describe the nature of the stratum immeadiately beneath the <br />material to be mined. <br />4. Rule 6.4.4(8) -you must identify the primary and secondary commodities to be <br />mined/extracted and describe the intended use (what will the material be <br />used for). <br />5. Rule 6.4.4(h) -you need to name and describe the intended use of all expected incidental <br />products to be mined/extracted by the proposed operation (if no incidental <br />products, say so). <br />6. Rule 6.4.5 -where will the natural fines come from and where will the material be <br />stockpiled? If the material is generated outside the permit area the applicant <br />must comply with Rule 3.1.5(9). <br />- the applicant is correct; there is very little topsoil at this site. However, there is <br />currently a thin veneer of soil which supports a fairly dense vegetative cover so <br />maybe the upper few inches of soil should be classified as growth medium <br />instead of topsoil. What thickness of growth medium will be replaced in the <br />disturbed area (eg 4"-8")? <br />- the seeding plan prepazed by the NRCS is acceptable. <br />- will the entire site be disturbed before initiating reclamation activities? If not, <br />provide a description of the size and location of each area to be reclaimed. <br />7. Rule 6.4.6 -the reclamation plan map must show the expected physical appearance of the <br />area of the affected land. The map must show proposed topography of the area <br />with contour lines of sufficient detail to portray the direction and rate of slope <br />of all reclaimed lands. Please revise the reclamation plan map to comply with <br />this Rule. <br />8. Rule 6.4.8 -the DOW recommends limiting new dirt removal to October through March <br />because of a potential impact to a burrowing owl. Will you commit to follow <br />the DOW's recommendation? <br />Prior to Division consideration of the application, you need to submit proof of publication (since <br />the previous notice is null and void because you published too early) and proof of all required <br />notices. <br />Please be advised that the permit application may be deemed inadequate, and your application <br />may be denied on luly 16, 2001, unless the above noted adequacy items are addressed to the <br />satisfaction of the Division. <br />If you have any questions, please give me a call. <br />
