AGREEDIENT

This Agreement made by and between the Board of County
Commissioners of Adams County, Colorado, (COUNTY) anu TP
Construction Company (CObiPA21Y):
IT IS UNDERSTOOD APID AGREED:
1. The COUNTY owns or has the right to possession to
527 acres of ground adjacent to the Adams County Regional
Park and the COUNTY has the right to extract sand and gravel
and other minerals on approximately A~ acres of said tract as
designated by Exhibit A.
2. The COMPANY has the equipment, manpower, and other
resources to competently extract the sand and gravel from
said tract and is willing to do so upon the conditions here-
inr°~er set forth.
3. The COUNTY, as the landowner, will obtain the nec-
~ssary zoning for the extraction of sand and ar~av~el from the
tract and the COiSPANY will make application to the State of
Colorado for ~. permi~t~ f~o~ ~uc~h.~extract~ion~
4. The C~ 'PAIdY and the COUNTY will jointly prepare the
necessary gravel extraction plans and the plans for reclama-
tion of the area following such extraction. The COU2ITY will
determine the configuration of the lake, the shape and location
of landforms, and the sloping for the shoreline. The COU:QTY
will also provide the revegetation plan, wildlife narrative,
and narrative describing the f ial after-use. The COMPAI]Y
will be responsible for fencing (the area designated pursuant
to paragraph 11), grading, sloping, and contouring. All opera-
tions by the COb:PANY will he such as to conform to the configu-
rations, plans, and standards of the COUNTY.
5, The COMPANY will commence mining operations as soon
as practicable after the issuance of the permit. It is con-
templated by the parties that such operations will begin in
November, 1977, but the COMPAPIY will coi.,.,.:nce operations
within 30 days after receiving written notice from the CO[TIdTY.
