Covering property located in Sections 16 and 17, Township 2 South, <br />Range 67 West of the 6th P.M., Adams County, Colorado <br />Gentlemen: <br />We have recently become aware of the application filed by CAMAS Colorado, Inc., <br />requesting approval of [heir proposed mining activity on both sides of the Soutlt Platte River <br />south of 104th Avenue in Adams County, Colorado. We are owners of property directly east of <br />this proposed mining area and wish to raise several concerns. <br />In August, 1997, we purchased approximately 108 acres of land in Sections 16 and l7, <br />Township 2 South, Range 67 West of the 6th P.M., commonly known as S&G Pit 27 from S&G <br />Properties, htc. The property is roughly bounded by East 104th Avenue on the north, East 100th <br />Avenue on the South, the Soutlt Platte River on the west and Brighton Road on the east. The <br />Fulton Ditch runs tlvough the center of the property, and bisects the area into what was known as <br />the east and west halves of S&G Pit 27. Enclosed are maps depicting this property. <br />We sold the west half of this property to CAMAS by General Warrranty Deed dated <br />August 29, 1997 and recorded September 8, 1997 in Book 5096 at Page 772 of the real property <br />records of Adams County, Colorado. We retained owntership of the east half (approximately 50 <br />acres), upon which is located a reservoir we stock with fish and utilize for recreational purposes. <br />A copy of the deed of the western pazcel to CAMAS is enclosed for your convenience. As you <br />can see in numbered paragraphs 1, 2, 3,4 5, 6 and 7 of the deed, there are several covenants and <br />conditions relating to the CAMAS property, none of which appear to have thus far been <br />mentioned in the application documents we have reviewed. In particular, please note the <br />following: <br />1. We reserved easements across the CAMAS property for a) reservoir outlet and water <br />com~eyancing purposes, b) ingress and egress, and c) fencing purposes. <br />
