Letter of Transmittal, Line Camp SWSP, 17 September 2004, Page 5 <br />although the outer edge of the pit was more than 100 feet from the Dolores <br />River, because of other conditions on the site, and this may still be the case. <br />We appreciate the information regarding "objectors" to our use of this water, and our <br />operations. We are concerned that there is nothing to demonstrate whether the two <br />attorneys, Mr. Preston or Ms. Geiger, indeed have any standing in this matter, since we <br />are uncertain as to exactly who they are presently representing. We understand that Mr. <br />Preston claims to be representing clients who are afraid of Four States Aggregates LLC <br />threatening them in some way, but believe this maybe only an excuse, since we do not <br />see how that we would or could threaten their clients in anv way, either through our use <br />of water or through any other means. As far as we know, Ms. Geiger represents only a <br />single lady (Mrs. Marilyn Boynton), who although she claims to represent "many people" <br />(statements made by her in testimony before the State Mined Land Reclamation Board), <br />is not an attorney, and is (to our last knowledge) a resident of the City of Cortez, owns no <br />property along the Dolores River, and therefore not a water user in accordance with state <br />law. Therefore, we do question whether the atoomeys are actually representing anyone <br />who has any standing to object to this action under Colorado law, and would appreciate <br />all additional information you have concerning these "objectors." <br />To summarize, the following documents are attached: <br />0 2004 Substitute Water Supply Plan (revised from 2001 Plan) <br />o Attachment 4 to the Plan <br />o Attachment 5 to the Plan <br />o Attachment 6 to the Plan (Update to T&K Study) <br />Please call with any questions.
