As directed, all calculations related to water from a "Catchment" area have <br />been removed from the Plan, and therefore, the original Attachment 6 to the <br />origina12001 Plan has been removed and replaced by a new Attachment 6 <br />(discussed two items below), Please also note that necessary calculations for <br />management of storm water associated with industrial activities, including <br />design of drainage structures and structural stone water pollution prevention <br />measures still include calculations for areas around the pit and open water <br />surface of the ponds, in order to comply to the best of our ability with the <br />various regulations implementing the Clean Water Act, and the conditions of <br />the storm water permit issued to, and enforced by, the Colorado Department <br />of Public Health and Environment. There will therefore be some potentially <br />significant differences in the calculations contained in this Plan and in the <br />Storm Water Management Plan and related documents. <br />7. The original Attachment 7 (Proposed accounting forms/procedures) to the <br />original 2001 Plan has been removed, and its content included in the main <br />body of the document. <br />8. Anew Attachment 6, The Update to the Tipton and Kalmbach study, a <br />separate document referencing the original study, has been made attachment 6 <br />and is included. The preparation of the Update was based on guidance of the <br />Division and on procedures and methods devised by USDA: in some cases, <br />the USDA publications to which Division staff members directed us had been <br />superseded by newer publications, and in that case, those newer publications, <br />which appeared to have the same method and procedures as the original <br />publications, were followed. <br />9. As directed, all calculations for loss of water in product have been changed to <br />show the water consumed at the time of mining and processing, NOT at the <br />time of shipment from the site, as done in the 2.001 Plan. <br />10. As explained in the original Plan, the purpose of showing all shipping of <br />material during the months of August and September was to create a <br />conservative (that is, high) estimate of the conumption of water during <br />periods when the historical consumptive use o1"the Home Ditch irrigation <br />water was lower. At no time did we intend to claim that mining activities <br />would ONLY be performed during that two-month period. However, in <br />accordance with the instructions, we have now included in the plan an <br />estimate of mining and processing of the sand and gravel over asix-month <br />period. Please note, this is ONLY an estimate and subject to change based on <br />market requirements, weather conditions, and availability of personnel and <br />equipment. <br />11. Based on the update to the Tipton and Kalmbach study and the Division's <br />guidance regarding "catchments" and other matters, we have gone back and <br />recalculated all water consumption and substitute supply through dry-up of <br />irrigated lands since the beginning of mining operations in 2001. The revised <br />summaries of monthly activities and water consumption and replacement are <br />contained in the Plan, using the same format as we are requesting for future <br />
