Simpson, P.E. <br />State Engineer <br />Your letter dated August 29, 2005, requesting renewal of the above referenced substitute water <br />supply plan to cover depletions caused by an existing gravel mining operation has been reviewed. The <br />required fee of $217 for the renewal of this substitute water supply plan has been submitted. The original <br />plan was approved on January 9, 1992, and was most recently renewed on September 22, 2004. <br />It should be noted that mining has been completed at the East Rigden site and construction of a <br />clay reservoir liner is in process on the property. Currently, the site is being dewatered at a rate of <br />approximately 500 gallons per minute. In addition, mined material is no longer conveyed from the adjacent <br />Resource Recovery Farm site to be processed at the East Rigden facility. A storage water right for the <br />East Rigden Pit was filed in the Division 1, Water Court in case no. 2001 CW202. <br />Lafarge leases the property from Flatiron Companies ("Flatiron"). Flatiron provides the water rights <br />for the augmentation at this site. In a letter dated December 30, 2005, Flatiron has notified this office that <br />Lafarge has completed the mining at the East Rigden Pit and any additional mining will likely be done by <br />Flatiron. The total exposed surface area at this site is 23.2 acres. According to the information submitted, <br />25 acres of water surface was exposed within the reclamation permit boundary prior to January 1, 1981. <br />Since the current exposed area is less than the area exposed prior to January 1, 1981, there is no <br />evaporation augmentation requirement at this site, for this approval period. The anticipated consumptive <br />use at this site consists of 1 acre-foot for dust suppression and 0.08 acre-feet for the office/asphalt <br />production plant septic system. The replacement requirement for this approval period is 2.2 acre-feet, <br />which accounts for the lagged depletions from consumptive use during this plan period and lagged <br />depletions accruing to the river from previous operations. <br />The proposed source of replacement water for this pit is one Box Elder Ditch share, which will be <br />recharged into a 7.9-acre pond located on the property. The 7.9-acre pond is included as part of the total <br />23.2 acres of pond surface area at this site and was created as a result of the mining operation. The Box <br />Elder Ditch share consumptive use was diverted into the pond during the 2005 irrigation season and is <br />part of the 8 shares that were historically used to irrigate 222.7 acres of corn, alfalfa and pasture grass at <br />the East Rigden site. The 222.7 acres historically irrigated by the referenced 8 shares of the Box Elder <br />Ditch have been taken out of the production. The historical use of the 8 Box Elder Ditch shares is <br />
