Mined Land Reclamation Page 2 <br /> June 13, 1983 <br /> Should Western Paving claim and show there is not a beneficial use of the pit <br /> water, the evaporation from the additional pond surface area created by mining <br /> would be considered a wasteful use of the ground water. Senior water right <br /> holders are rightfully entitled to this water. If there was a wasteful use of <br /> water, our Division Engineer would order Western Paving to cease operations in <br /> compliance with CRS 1973, 37-92-502(2). <br /> Western Paving discusses the potential impacts of the proposed gravel pit <br /> operation on ground water in the Hydrology Section of the application. In <br /> this section, the applicant states that monitoring wells will be installed to <br /> the south and east of the mining area before mining takes place. The appli- <br /> cant later assures that "should it appear that adverse effects may result from <br /> the mining operation, measures will be taken by Western Paving to correct the <br /> problem". How does Western Paving plan on mitigating any potential adverse <br /> effects on nearby wells due to the mining operation? We believe that a repre- <br /> sentative of Western Paving should meet with well owners near the proposed <br /> gravel pit if they have not done so already to inform them of Western Paving's <br /> aforementioned policy and to mitigate concerns that the well owners have <br /> regarding the gravel pit. Our office would like to be given an account of any <br /> agreements arrived at between these parties. <br /> Until Western Paving obtains a well permit, we cannot recommend approval of <br /> this gravel pit operation. Further, we will order Western Paving to cease <br /> operations if our Water Commissioner determines that ground water has been <br /> exposed without a well permit. <br /> HDS/JRH:ma <br /> cc: Jim Clark, Div.
