Please note that the notarized <br />agreement provided states that "Weld County agrees to allow LRM to mine the site as long as <br />LRM maintains a minimum offset distance of 80 feet between the pit excavation limits and any <br />offsite structure. Review of Exhibit C-2, Mine Plan shows a setback distance of 70' Half Right <br />of Way. Please revise the Exhibit C-2, Mine Plan map as necessary to verify the agreed upon <br />setback distance of 80'. If a revision is not necessary, please provide a clarification of the 70' <br />setback listed. <br />13. Attached is a copy of a letter received from James Byrne of the Poudre Valley Rural Electric <br />Association indicating his request for unimpeded access to their electric facilities for <br />maintenance and operation purposes. Please address. <br />Once again, I will look forward to your response on or before February 23, 2007 to allow <br />adequate time for review before the March 5, 2007 decision date. Rule 1.8.1 states that changes <br />and additions to the permit application must be filed with the Division and the County Clerk and <br />Recorder.
